Terms of Use
These terms are the agreement between you and Oussama Elhaidi for using the Nova Numbers iPhone app and this website. Installing or using the app means you accept them.
1. This agreement
“We”, “us” and “our” mean Oussama Elhaidi. “You” means the person using the app. If you do not agree with these terms, please do not use Nova Numbers.
Nova Numbers is distributed through the App Store, so Apple’s Standard End User License Agreement also applies. Where these terms and Apple’s EULA disagree about the licence to use the app, Apple’s EULA wins.
2. Who can use it, and who agrees to this
Nova Numbers is an educational practice app for learners of all ages, including children, intended to be set up and supervised by a parent, guardian or teacher.
You must be 18 or older, or the age of majority where you live, to accept these terms and to buy a subscription. By setting the app up for a child, you confirm you have the authority to do so and that you accept these terms on their behalf.
Buying or managing a subscription, the Grown-ups area, and links that leave the app sit behind a parent gate. It is a barrier against accidental taps, not a security control, and it does not replace your supervision.
3. What the app is, and is not
Nova Numbers generates short arithmetic questions for each lesson, reads handwritten answers on the device, and tracks stars and progress. It also teaches numeral formation (Number Writing), explains a missed question on a number line, and brings questions a child got wrong back on a spaced schedule (the Repair Bay). It is practice material. It is not a curriculum, a tutor or a substitute for teaching.
The app does not:
- provide a formal, standardised or diagnostic assessment of a child’s math ability;
- identify a learning difficulty, or suggest a child has one;
- replace a school curriculum or the judgement of a teacher;
- guarantee any particular educational outcome.
The Skills Check places a child at a sensible starting difficulty. Treat its result as a starting point, not a verdict.
Handwriting recognition is experimental. It sometimes misreads answers, which is why the app shows what it read and always offers a typed answer instead.
4. Answers and progress
Handwritten answers are read on the device and discarded after each question. They are never saved, shared or used to train anything. Progress, stars and settings are stored only on the iPhone; we have no copy of them.
Questions a child did not get right first time are kept on the device so the Repair Bay can bring them back, and the grown-ups’ progress report is built from counts of practice kept on the device. Neither includes anything a child wrote or drew.
You can reset learning progress in the Grown-ups area, and deleting the app removes everything it stored. There is no export, because there is no account. See the Privacy Policy for details, including the anonymous subscription information handled by RevenueCat.
5. Nova Premium subscription
Subscription access in version 1.0.1 and later. An active Nova Premium subscription is required for the Skills Check and all learning, including Foundations, Number Writing, the Repair Bay and the progress report. All four worlds contain 100 arithmetic lessons in total. There is no free trial. Earlier versions may have different access rules.
Eligible first-year offer. An eligible Apple Account may be shown an annual welcome subscription at 50% off for the first year. It is a paid introductory year, not a free trial. Apple determines introductory eligibility within the subscription group. Availability and prices vary by storefront; the offer is shown only where the store price supports the discount. The first-year price and full annual renewal price are displayed before purchase. Closing the offer returns to the regular subscription plans and does not unlock learning.
- Plans. Nova Premium is available as a monthly or a yearly auto-renewing subscription. Both plans give the same access. Prices are shown in the app before you buy, in your local currency, and may vary by country.
- Billing. Payment is charged to your Apple Account when you confirm the purchase.
- Renewal. The subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Managing and cancelling. Open Settings on your iPhone, tap your name, then Subscriptions. You can also tap Manage Subscription in the app’s Grown-ups area. Cancelling stops the next renewal; you keep Premium until the end of the period you have already paid for. When a subscription ends, learning requires renewing or restoring an active subscription. Learning progress stays saved on the device.
- Restoring. On a new or reset device, tap Restore Purchases in the app while signed in with the Apple Account that bought the subscription.
- Family Sharing. Sharing is available only for subscription products that support it in the App Store. The welcome annual subscription does not currently support Family Sharing.
- Refunds. Purchases are made from Apple, so refunds are handled by Apple under its own terms. We cannot issue refunds for App Store purchases. You can request one at reportaproblem.apple.com.
- Price changes. If a price rises, Apple will notify you and, where its rules require, ask for your consent before the new price takes effect.
6. No advertising
There is no advertising in Nova Numbers: no banners, no interstitials, no rewarded video and no advertising SDK. Nothing about a child is used for advertising or profiling, and we do not sell or share data with data brokers. The only purchase in the app is the Nova Premium subscription described above.
7. Acceptable use
You agree not to:
- copy, resell, rent or redistribute the app;
- reverse-engineer, decompile or tamper with it, except where the law allows it regardless of this term;
- work around the subscription, or use the app in a way that breaks the App Store’s terms;
- use it for anything unlawful.
8. Ownership
We own the app, its source code, its lesson content and its original artwork, including the mascot Orbi, the planets and the worlds. You get a personal, non-transferable, non-exclusive licence to use it on Apple devices you own or control, under Apple’s EULA. Nothing here transfers ownership to you.
9. Availability and changes
We may update the app, change or remove features, or stop distributing it. We will not knowingly remove core learning features during a subscription period you have already paid for. If we change these terms in a way that matters, we will update the date at the top of this page before the change takes effect.
10. Disclaimers
The app is provided “as is”. To the fullest extent the law allows, we make no warranty that it will be uninterrupted, error-free or fit for a particular purpose, that handwriting will always be read correctly, or that using it will produce any particular improvement in a child’s math.
11. Liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss arising from your use of the app, and our total liability for any claim is limited to the amount you paid for Nova Premium in the twelve months before the claim.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have rights under local consumer law that these terms do not affect.
12. Apple
These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app. Apple is not responsible for the app or its content, or for any claim you have about it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer protection claims, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Ending this agreement
You can end it at any time by cancelling any subscription and deleting the app, which also removes the data it stored. We may end it if you materially breach these terms. Sections 8, 10, 11 and 14 survive.
14. Governing law
These terms are governed by the laws of Morocco, without regard to its conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in your local courts where local law gives you that right.
